When this website went live (Saturday 24th February 2007) we received emails stating that our house was resold and that people are living there. At first we thought if people are living there they must be renting because our Contract is still at the land registry. However with a little investigation we found out that Michelle McDonald made these posts on the Eastern Cyprus forum:-

When we started our fight back 3 weeks ago it was us against Karayiannas (K&Co), we didn’t know they had thrown another family in the way. We ignored the first emails that came in saying “our house was resold” thinking it was K&Co playing tricks, trying to upset us or even baiting us into make a false statement publicly.
We had misread your post that mentioned 30 Ayios Sergios and thought this meant you were renting there while waiting for a different house to be finished.
By now we’re sure you have read our website lyingbuilder.com which tells our story up till about November 2006. We have uploaded all court papers for your eyes only on a hidden page on the site. The documents are large in size and we guess you’re on dialup so we thought this would be the best way.

Statement of Claim (November 2006)
K&Co. were able to start proceedings first as we were still trying to find the best lawyer for the job. As you can see from their “statement of claim” They are trying to say we were in breach of contract and have caused them damages etc. It’s all BS as our website shows and we are confident that they will loose their case when they have to start producing evidence. i.e. demands for payment? Loss of income? Missed payments? etc.
There is a paragraph on their claim that also states:-26. The defendants filed the said contract at the Lands Office for purposes of specific performance and now it is not possible to sell the house or file a similar agreement to the Lands Office. If the registration or filing remains in place then it will not be possible to transfer to any one else the house sold. The registration in the Lands Office bares the number ΠΩΕ 1064/2005.
Which is why our lawyer is shocked at what Pittadjis and K&Co have done to you.
Our lawyer was instructed to write to Pittadjis last week (Both Anna Michael’s and George Pittadjis) and ask them to explain themselves. We are still awaiting a copy of that letter.Our Defense and Counter Claim. (Jan 2007)
Sorry this is in Greek. We obviously approved the drafts in English but as there were some last minute changes its appropriate we only show what was submitted to the court.
It basically says we deny all their accusations of defamation, there are no lies on our website, we are entitled to report bad customer service and in any event they should take it up in the UK courts where the website is published.
It says that they are not entitled to award themselves damages.
It says there was no breach of contract and that the contract still stands.
It says if the court decides the contract is to be cancelled K&Co. will pay us the full current market value (not the 2005 price we bought off plan)
It says they will pay us damages £975 pcm rent, Lawyer fees, interest and the rest.The last court paper is their response to our Counter Claim. (Feb 2007) Which say’s point by point “no they won’t”
So the next stage is to produce documents to the court.
That’s where we stand Michelle. Apart from the assault charge against K&Co. there is nothing much more to tell you. We’re going to let the solicitors do their thing. If you need to you can take all correspondence to a lawyer with our contract (which is online).
As you know we have started a relentless campaign to warn others about this company. Had we not remained quiet last year you may never have been in this situation. It’s important that others do not fall for the way Marios does business. We are getting other disturbing reports about them coming in. I will only publish things I have proof of and that will only come when I'm next in Cyprus.
We called a halt to the forum when we learnt about yourself. We hope now the dust has settled a little and you’re keen to find out what’s going on.We know you’re in a difficult position and possibly even friends with Marios and Michelle Anglou. We despise these people and believe they are immoral.
If they didn’t tell you the truth last year, we hope you realise they should not be trusted now. We are in touch with sympathetic estate agents, lawyers and rival developers who are furious that K&Co and Pittadjis are bringing the industry into disrepute. They will absolutely never get away with this.We don’t know how and when you found out about us; please let us know your story.
Did Karayiannas deceive you last year or were you aware of us and told things would be sorted by now?We’re pretty sure Karayiannas are not going to settle matters soon, if you have any insight into things please share. We’re getting emails requesting an update to our forum thread; we won’t do this until we have heard from you.
Well that’s where we stand Michelle. We believe we’re both victims of this company but without knowing your feelings on the matter we just don’t know.

There is a member of this forum who can possibly end the anguish to my family by simply telling her story. Either to us, the police, or the law society. Her story is the worst kept secret in Frenaros. She is a “customer” of Karayiannas who is connected to our case. We sent her a letter a month ago and urge her to respond and take independent advice.”

Re: House No.30 at Ayios Sergios – Frenaros – Cyprus.
We have been instructed by our clients Mr. Conor O’ Dwyer and Mrs. Michaela O’ Dwyer, from the U.K. to inform you the following:
Our clients have purchased the above mentioned house by a duly signed sale agreement dated 23.8.2005. This sale agreement is filed with the District Land Registry (DLO) something which is possible to confirm through an application to the DLO.
In breach of the terms of the said sale agreement, Christoforos Karayiannas & Son Ltd has not yet delivered the house to our clients and as a result litigation is pending in Court (Action no. 365/06 D. C. Famagusta) regarding the above dispute between our clients and Christoforos Karayiannas & Son Ltd, in which our clients claim amongst other delivery to them of their house and damages.
Our clients have been recently informed that not only you illegally occupy their house, but it has been illegally sold to yourself even though you had notice or should have had notice that our clients are and remain beneficial owners of the said house and therefore any agreement made with any other person besides our clients is illegal and has no legal affect whatsoever.
Taking into consideration all of the above, we hereby inform you that unless you vacate our clients’ house within 21 DAYS from receiving the present letter, our clients shall have no other option but to take all necessary legal steps to protect their interests demanding your eviction and/or damages.
Please note that all of the above do not affect or prejudice in any way our clients’ right to claim any other remedy or remedies they are legally entitled against yourself or any other third person.

Jumping to Michelle McDonalds Defense: Her lawyer (and Karayiannas lawyer) George Pittadjis says "she was told that a previous contract had been cancelled" and that, she had "no idea there was such a dispute"
Amazing!! Seeing as the Pittadjis Law firm has been representing Karayiannas in this dispute and then assists in the unlawful selling of our house to the McDonald family. So are they admitting that they misled their client and did not give her proper representation?
Michelle McDonald is still using this lawyer and living in our house instead of reporting any misconduct or fraud.
